Sanctions

In the event of non-compliance with the Listing Rules and its implementing provisions SIX Exchange Regulation and the Sanction Commission may impose sanctions against the issuer in question.

In particular, sanctions may be imposed in the following areas:

  • Ad hoc Publicity
  • Financial Reporting
  • Regular Reporting Obligations
  • Corporate Governance
  • Management Transactions

In accordance with Art. 61 para. 1 LR, the following sanctions may be imposed on issuers, guarantors and recognised representatives:

  1. reprimand;
  2. fine of up to CHF 1 m (for negligence) or CHF 10 m (if deliberate);
  3. suspension of trading;
  4. delisting or reallocation to a different regulatory standard;
  5. exclusion from further listings;
  6. withdrawal of recognition.

The aforementioned sanctions may be pronounced cumulatively.
