Means of Legal Redress in connection with Enforcement

Sanction notices of SIX Exchange Regulation may be appealed to the Sanction Commission within 10 exchange days of the notification of the decision. Decisions of the Sanction Commission may in turn, within 20 exchange days, be appealed by complaint to the Board of Arbitration of the SIX Swiss Exchange.

However, if the Sanction Commission decides upon sanctions within the context of Art. 61 Points 3 and 4 (suspension of trading and delisting) or the exclusion of participants or revocation of a traders registration, the decision may be brought to the Appeals Board of the SIX Swiss Exchange by appeal. Such appeal must be lodged within 20 exchange days after notification of the descision.

Means of legal redress may be sought only in the case of final decisions. Fundamentally, means of legal redress are accorded suspensive effect. In order to safeguard the securities markets' ability to function properly, as well as to ensure transparency and the equal treatment of all market participants, the Sanction Commission may revoke the suspensive effect of a legal remedy.

Other Means of Legal Redress

Parties wishing to appeal decisions regarding:

may lodge an appeal with the Appeals Board within 20 exchange days after notification of the decision. If the decision is published, the period for appeal begins at the time of publication. The Appeals Board may grant suspensive effect to the appeal; however, this does not apply to decisions pursuant to Art. 57 LR. The decisions of the Appeals Board may, within 20 exchange days, be presented by complaint to the Board of Arbitration of the SIX Swiss Exchange.
